Divorce Residency Requirements in West Virginia
Before you can file for divorce in West Virginia, you have to meet the state's residency requirement. If the parties were married in West Virginia, either spouse must be a current resident at filing. If married elsewhere, at least one spouse must have lived in West Virginia for 1 year before filing.
